Bird Crazy Mail Terms Of Service

By signing up and actively using the Bird Crazy Mail program you agree to all terms and conditions set forth in this agreement. Bird Crazy Mail may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with Bird Crazy Mail.

If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Bird Crazy Mail program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members:
You must be 16 years of age or older to participate in this program. Our program is open to members from all countries who read and understand English and is void where prohibited by local governing laws.

As of 2-24-08, We no longer accept new members from the following countries: China,Hong Kong, India, Poland, Russian Federation, Taiwan, and Thailand.

You agree to and must use your full name, address and email address in the sign up process and may not assume a false identity; also abbreviations or gibberish are not acceptable. You may not sign up multiple times with different information. Your computer must not be shared with another individual that has an existing BirdCrazyMail account. For security and fraud prevention reasons, BirdCrazyMail only allows one account per IP address, household, physical address and/or postal address.

You will use your user ID/password combination to access your account. It is your responsibility to keep this information confidential. When necessary, you may change your password by logging into your account and following the "User Account Info" link. You are solely responsible for any and all use of your BirdCrazyMail account including authorization by you to any third party individual who may use your account.

You must maintain your e-mail account that you used when signing up with the site.You agree to receive e-mail advertising from BirdCrazyMail.

In the event that your e-mail address becomes closed or blocked to messages from BirdCrazyMail, your account will be set to "site inbox". This especially applies to e-mail accounts returned for being Full. If you take your account off of site inbox, but continue to bounce mails, your account may be terminated. Your account will be suspended. You will then need to contact support to regain access to your account and change your email address. If you fail to do so within 10 days, your account may be terminated.

Due too many emails bouncing we do no longer accept email addresses from certain domains.Please see the banned email page, here, for a complete list. More domains may be added if necessary.

Advertising and Redemptions:
BirdCrazyMail is for English speaking members. Therefore, all advertised sites must be in English. There are no exceptions to this and it includes all ads within the site.

We do not accept any advertising for adult content, gambling, drugs of any kind, or any thing that could be classified as illegal. We do not accept advertising for sites that use 0iframes, auto searches or containing malware. If you submit an ad for a site such as these, or a site on our banned list, you will not be refunded. However, on the first instance, you will be notified that your ad was rejected and you will be given the chance to send a replacement link. Any ad for the banned site that is submitted after that will be rejected with no replacement or refund. Please review our banned sites list Here.

If you submit an ad and it is found to have been changed once they have been approved and published, the ad will be pulled and there will be no refunds for any unused hits.

BirdCrazyMail is not responsible for the content or validity of ANY ad sent.

While every attempt is made to send advertisements for sites that are virus and trojan free, BirdCrazyMail is not responsible for any infections that you get while visiting advertised websites. We do however ask that you keep watch of advertised links and the moment such a link with an infection is discovered to email support. We will delete the ad promptly.

In the event of a charge back all advertising will be immediately deleted. If you are a member, your account will be terminated as well, losing all earnings and referrals.

At no time are you allowed to sell upgrade ads or redemptions. Those are available only to you as a member. No one else. If you are found selling redemptions or upgrade ads, all submitted ads will be rejected, and your account deleted.

Payments:
Members may earn by reading paid-emails and visiting the advertiser websites after they have logged into the member area on the website. Members may earn by referring new affiliates to the site. Members will earn 15% of their direct referrals earnings. Members must be at least 25% as active as their downline to earn referral commission.

Once the member has reached the payout set by BirdCrazyMail, they may request payment. Members may only request payment once per 30 days, for a maximum of $10.00.

Payouts will be made by PayPal, E-Gold, or Money Order. The Payment account MUST be registered to you (you may not share your payment account with another user). At this time there is no fee for payment through PayPal and eGold, but one could be implemented if needed.

Money order payments are available to members in the US and Canada only. There is a $2.00 Fee for processing Money Order Pay-Outs.

If your account does not meet the terms of the site, your payment request will be denied. This includes agreeing to these terms in your user info.

Payments will be made within 30 days or a reasonable time after.

Activity:
Your account will be considered inactive if you do not log in every 30 days and click at least 1 tracking link. Once inactive, your account will be suspended. You will then need to contact support to have your account reinstated. Failure to do so within 15 days, will result in deletion of your account. Logging into your account, but not clicking is not considered active.

Members who have paid to upgrade will, however, be given a more reasonable length of time before their accounts are deleted for inactivity. If an upgraded member has been inactive for a period of 30 days or more, their account will be suspended. They will need to contact support to have their account reinstated. Failure to do so within 30 days following the suspension will result in account deletion.

Members who receive the free 6 month upgrade must maintain 50 clicks per month. Failure to do so will result in the revocation of the upgrade without warning or notice. Once the upgrade has been removed from your account, it will not be reinstated.

New members must click 3 links within the first 10 days of membership or their account will be deleted.

Vacation mode:
When you put your account on vacation you also need to take it off when you come back. Failure to do so may result in account deletion. Accounts that are on vacation or inactive do not receive downline earnings, payouts requested or random payments. If you plan on being away over 30 days then you need to contact support and request permission for an extended vacation. Logging in to extend your vacation for more than the 30 days will result in account termination.

Affiliate pages:
Members who purchase affiliate pages may promote their pages nearly anywhere. This excludes autosurfs, 0iframes, popups, popunders, and floating ads. Affiliate page owners will be responsible for keeping their account active. Any member who owns an affiliate page will lose their page if they are deleted for inactivity, fraudulent activities, or cheating.

Fraud and Termination of Accounts:
Should any instances of fraud, system abuse, or any type of activity deemed inappropriate or illegal by BirdCrazyMail be detected, it will result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination. Sending us mail that contains hate related content, foul or vulgar language, or gibberish will result in automatic termination of account and forfeiture of All earnings.

The use of proxy is strictly prohibited. If you are found using a proxy to disguise your true identity or whereabouts, your account will be deleted.

The use of any type of email reading or clicking software is considered fraud. Members found to be using and/or promoting this type of software will have their account terminated immediately, forfeiting all earnings.

Multiple sign-ups shall be grounds for immediate termination of all accounts involved, forfeiting all earnings. Signing up multiple times from the same computer, IP address, or the same household is considered fraud.

Members hiding their identity by using abbreviations or gibberish will have their account terminated immediately, forfeiting all earnings.

Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination.

A member whose account is terminated because of fraud will not be allowed to rejoin the site.

Cheat detection: We have a "Zero Tolerance" for cheating. Using ANY kind of "cheating" software, mass sign-up software or link grabbing software is strictly prohibited and will result in account deletion.

BirdCrazyMail uses both visible and invisible cheat detection methods to ensure that you are actually reading and understanding email advertisements and visiting websites without the use of cheat software. This includes, but is not limited to banners, English tests, categories of interest (keywords), and turing numbers.

If you click 3 or more cheat links, you will lose your account including all earnings and referrals.

Be careful of what you read. Fail 3 English tests and your account will be deleted, losing all earnings and referrals.

Certain keywords are placed in the categories of interest to detect whether a member understands the English language. If one or more invalid keywords are chosen, you will lose your account and all earnings and referrals. This includes selecting the "search" options when you are from a non search country, and "no understand english".

You will lose your account if you click 15 wrong turing numbers in any given month. Counters are reset monthly to ensure accuracy. However, if you seem to have a problem reading the given turing number, you may contact support and have them removed.

Members who are caught cheating will have their account terminated, here and at all family sites if they are a member, will forfeit all earnings, and will not be allowed to rejoin.

Once an account is terminated it will not be restored.

Relationship of the Parties:
You and Bird Crazy Mail are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Bird Crazy Mail. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Bird Crazy Mail. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
Bird Crazy Mail will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Bird Crazy Mail program, even if Bird Crazy Mail has been advised of the possibility of such damages. Furthermore, Bird Crazy Mail aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Bird Crazy Mail and may result in legal prosecution. Bird Crazy Mail strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Bird Crazy Mail may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Bird Crazy Mail will file charges for recovery of any earnings received from multiple sign-ups.

Emailing referral links to the webmaster is considered spam. You do not like to receive spam, and we do not like it either. If you are found spamming the webmaster via any email address he/she uses, your account will be deleted.
